Official Rules THE "FOX SEARCHLIGHT PICTURES / IN AMERICA SWEEPSTAKES" OFFICIAL RULES NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. RESIDENTS OF THE U.S. WHO ARE AT LEAST 18 YEARS OF AGE ARE ELIGIBLE TO ENTER AND WIN.  VOID IN PUERTO RICO AND WHERE PROHIBITED.  The “Fox Searchlight Pictures – In America … The American Way Sweepstakes” (“Sweepstakes”) is sponsored by Fox Searchlight Pictures (“Sponsor”).  Sweepstakes begins at 12:00:01 a.m. Eastern Time (“ET”) on 11/01/03 and ends at 11:59:59 p.m. ET on 12/31/03 (the “Sweepstakes Period”).  Internet Participants Note: This Sweepstakes is intended for participation in the United States only, and shall be governed by and construed in accordance with U.S. law. Do not enter this Sweepstakes if you are not located in the U.S. at this time.   ELIGIBILITY:  Sweepstakes is open to legal residents of the fifty (50) United States (including the District of Columbia) who are eighteen (18) years of age or older at the time of entry.  Void in Puerto Rico, overseas U.S. territories, possessions, commonwealths and military installations, and where prohibited by law.  Employees, officers, directors, agents, representatives (including immediate family members – parents, spouses, children and siblings – and members of the same household) of Sponsor, KCBS-FM Marketing (“Administrator”), their parent companies, affiliates, and subsidiaries, advertising, promotion agencies, and promotion partners, and any others associated with this Sweepstakes are not eligible to enter or win.  All federal, state and local laws and regulations apply. HOW TO ENTER: There are two ways to enter the Sweepstakes.  TO ENTER ONLINE: Visit “www.foxsearchlight.com”, select the Fox Searchlight Pictures / In America Sweepstakes Promotion banner, advertisement or link (as applicable) to open a new Online Entry Form webpage (“Entry Website”).  On the Online Entry Form, enter your first and last name, zip code, daytime phone number, date of birth and your valid e-mail address.  All online entries must be received by 11:59:59 p.m. ET on 12/31/03. For purposes of these Official Rules, “receipt” of an online entry occurs when the Entry Website’s servers record the entry information upon clicking the “Submit” button.  Any automated computer receipt (such as one confirming delivery of e-mail) does not constitute proof of actual receipt by Entry Website of an online entry for purposes of these Official Rules.  Each online entry will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry.  “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet Access Provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.  TO ENTER BY MAIL:  Legibly handwrite your first and last name, date of birth, complete address, including zip code, daytime telephone, and valid email address (optional) on a postcard or 3x5” piece of paper and mail to “Fox Searchlight Pictures / In America Sweepstakes,” c/o KCBS-FM Marketing, 5901 Venice Blvd., Los Angeles, CA 90034.  Entries must be postmarked by 12/31/03 and received by 01/07/04 to be eligible.  All mail-in entries must be handwritten.  No photocopied or mechanical reproductions permitted.  All entries submitted become the sole property of sweepstakes Sponsor and cannot be returned.  There is a limit of one entry per person, regardless of method of entry, during the Sweepstakes Period.  Multiple entries are ineligible.  Entries that are late, forged, illegible, mutilated, postage due, incomplete, misdirected, or otherwise not in compliance with these Official Rules will be disqualified. SELECTION OF WINNER, ODDS:  The potential winner will be selected in a random drawing on or about 01/16/04 from all eligible entries by the Administrator whose decisions are final in all respects. The prize will be awarded. Entrants need not be present at drawing.  Odds of winning depend on the number of eligible entries received.  NOTIFICATION:  Potential winner will be notified by US Mail on/about 01/23/04.  Potential winner will be notified by mail and must sign and return an Affidavit of Eligibility and Liability/Publicity Release (where legal), and IRS Form W-9 within 14 days after issuance or prize will be forfeited and awarded to an alternate in a random drawing of all remaining eligible entries. Return of prize notification as undeliverable will result in disqualification and selection of an alternate winner in a random drawing of all remaining eligible entries. Entry constitutes winner’s permission to the use of their name, photograph/likeness by Sponsor for advertising and promotional purposes without additional compensation, except where prohibited by law. GRAND PRIZE: One (1) grand prize will be awarded. Grand Prize consists of a 4-day/3-night trip for four (4) (winner and 3 guests) to New York, New York, including round-trip coach class airfare for four (4) persons departing from the major U.S. airport nearest to winner's home; two (2) double occupancy deluxe hotel accommodations for 4-days/3-nights at a hotel determined by Administrator’s choice; ground transportation between winner's home and airport nearest to winner's home and to/from airport and hotel; four (4) tickets to Ellis Island Immigration Museum; and four (4) tickets to a Broadway show (show selection is at the sole discretion of the Administrator and is subject to availability). Approximate retail value:  $4,000, but will vary depending on travel origination and fares in effect at the time of departure.  No prize substitutions, cash equivalent, or transfer of prizes permitted except at the sole discretion of the Sponsor. Prize subject to availability and Sponsor reserves the right, at its sole discretion, to award a prize of greater or equal value if the advertised prize is unavailable. All other costs not specifically stated herein, including, but not limited to, taxes, meals, beverages, alcoholic beverages, tips and other ground transportation, are the responsibility of the winner. Taxes are the sole responsibility of the winners. Trip must be taken within one (1) year of date of prize award.  Reservations for the Grand Prize trip must be made through Administrator's agent, on a carrier of Administrator's choice, at least 30 days prior to intended travel. Blackout periods and other restrictions, conditions, and limitations may apply. Complete terms and conditions of trip will be furnished with prize notification. Once travel itinerary is confirmed, winner may not be able change trip dates and travel accommodations. Travel companions of Grand Prize trip winner must travel with winner on the same itinerary. In addition, travel companion of Grand Prize trip winner must be 18 years of age or older, unless the winner is the parent/legal guardian of such minor travel companion. Winner and travel companion are responsible for all required travel documents. Winner and travel companion are responsible for obtaining travel insurance (and all other forms of insurance) where applicable, at their option, and hereby acknowledge that the Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. Grand Prize winner and travel companion, or the parent or legal guardian if companion is under 18 years of age, must sign a Publicity, Liability Waiver and Travel Release form prior to traveling. If a selected event is unable to take place as scheduled, for reasons such as cancellation, preemption, postponement or unavailability, or for any reason beyond the control of the Sponsor, Sponsor's sole responsibility to a Grand Prize winner will be to award the remaining available portion of the prize and no substitution will be provided for unawarded portion of prize. Odds of winning depend on the total amount of eligible entries received for the applicable drawing. CONDITIONS:  By entering, participants agree to be bound by these complete Official Rules.  All federal, state and local laws and regulations apply.  Sponsor and Administrator, their parent companies, affiliates, and subsidiaries, advertising, promotion agencies, and promotion partners, and the officers, shareholders, directors, employees, agents and representatives of each of them are not responsible for, (i) late, lost, delayed, damaged, misdirected, incomplete, stolen, postage due, inaccurate, or illegible entries; (ii) entries not received due to difficulty accessing the Internet, service outages or delays, computer difficulties, other technological or mechanical malfunctions, or inaccurate entry information, whether caused by equipment, programming used in this Sweepstakes, human processing error or otherwise; (iii) any and all claims or liability arising directly or indirectly from the prize or participation in the Sweepstakes; or (iv) typographical, printing, distribution, production or other errors. Return of prize or prize notification as undeliverable will result in disqualification and an alternate winner will be selected. Entry and/or acceptance of prize(s) constitutes permission for the Sponsor and its agencies to use the winner’s name, address (city and state) and/or likeness for advertising and trade purposes without further compensation or authorization, worldwide and in perpetuity, in any and all forms of media, now known and hereafter devised, including without limitation Internet, unless prohibited by law.  Any person attempting to defraud or in any way tamper with this Sweepstakes will be ineligible for prizes and may be prosecuted to the full extent of the law. Sponsor and Administrator reserve the right, in their sole discretion, to cancel, modify or suspend this Sweepstakes or any portion of this Sweepstakes should a virus, bugs, non-authorized human intervention or other causes beyond the reasonable control of Sponsor and Administrator corrupt or impair the administration, security, fairness or proper play of the Sweepstakes and, in any such event, select winners from those on-line or mail-in entries received prior to the event.  Sponsor and Administrator reserve the right to make changes in the rules of the sweepstakes, including the substitution of a prize of equivalent value, which will become effective upon announcement.
